These terms of use govern access to and use of the IslandMetrics platform

1. Ownership

All rights, title, and interest in and to the IslandMetrics platform, including all software, systems, methodologies, calculation frameworks, dashboards, and report structures, remain the exclusive property of IslandMetrics.

2. License Grant

Clients are granted a limited, non-exclusive, non-transferable right to access and use the platform and its outputs for internal operational purposes only.

3. Restrictions

Clients may not copy, reproduce, or replicate the platform; reverse engineer or attempt to extract underlying logic; redistribute, resell, or sublicense outputs or system components; or use the system to build competing tools or frameworks.

4. Data Ownership

Clients retain ownership of all raw operational data submitted to the platform. IslandMetrics retains ownership of all system-generated outputs, methodologies, scoring systems, analytical frameworks and structures.

5. Suspension / Termination

IslandMetrics reserves the right to suspend access for non-payment or misuse. Termination does not transfer any intellectual property rights.

General Legal Provisions

Limitation of Liability

IslandMetrics shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to the use of the platform, including but not limited to operational decisions, financial outcomes, or performance results derived from platform outputs.

No Warranty / Platform Use

The IslandMetrics platform and all outputs are provided on an “as isˮ and “as availableˮ basis. While reasonable efforts are made to ensure consistency and accuracy, IslandMetrics makes no warranties, express or implied, regarding the completeness, accuracy, reliability, or suitability of the platform for any specific purpose.

Acceptable Use

Users agree to use the platform solely for its intended operational purposes. Users may not misuse the platform, interfere with its functionality, attempt unauthorized access, or use the system in any manner that could compromise its integrity, security, or performance.

Governing Law

These Terms of Use shall be governed by and interpreted in accordance with the laws of Barbados. Any disputes arising from or related to the use of the platform shall be subject to the exclusive jurisdiction of the courts of Barbados.

Modifications to Terms

IslandMetrics reserves the right to update or modify these Terms of Use at any time. Continued use of the platform following any updates constitutes acceptance of the revised terms.
